Business suspension

Legal regulations on enterprise operation suspension:

Business suspension is when an enterprise temporarily does not conduct any business activities for a certain period. Enterprises shall send a notice to the competent authority where the enterprise is headquartered before the date of the business suspension in accordance with law.

During the suspension period, enterprises are not allowed to use invoices, are not required to submit reports on invoice usage, and are not required to submit tax declarations, except in cases where the enterprises suspend operations for less than a full month, quarter, calendar year, or fiscal year, enterprises still have to submit monthly and quarterly tax declarations; and annual finalization documents.

The business suspension period of each notification must not exceed one (01) year.

Enterprises that continue to suspend business after the expiration of the notified period shall send a notice to the competent authority where the enterprise is headquartered before the expiration date of the suspension in accordance with law.

Enterprises cannot register to suspend business when the tax authority has notified them that the enterprise is not operating at the registered address.

All dependent units under the enterprise will be automatically converted to business suspension on the National Business Registration Portal when the enterprise registers suspension.

Enterprises can request to register to continue doing business before the announced suspension period.
