Invention

An invention is a technical solution in the form of a product or process that aims to solve a defined problem by applying natural laws.

General conditions:

• Inventions are protected in the form of invention patents when they meet the following conditions:
  • Newness;
  • Creative level;
  • Capable of industrial application.

An invention patent is valid from the date of issue and lasts 20 years from the date of filing;

• Inventions are protected in the form of utility solution patents if they are not common knowledge and meet the following conditions:
  • Newness;
  • Capable of industrial application.

A utility solution patent is effective from the date of issue and lasts until ten (10) years from the date of filing;

The following objects shall be ineligible for protection as inventions:

• Scientific discoveries or theories, mathematical methods;
• Computer programs;
• The solution only has aesthetic properties;
• Methods of prevention, diagnosis, and treatment of diseases for humans and animals;
• Some other subjects according to the law.

Gia Luat's scope of work:

• Consulting Valued Customers on legal issues related to Inventions:
• Guiding Valued Customers to prepare necessary documents and records; Check the legality and validity of documents provided by Valued Customers; 
• Preparing documents in accordance with the law;
• Representing Valued Customers to submit documents and work with competent authorities;
• Following up documents and explain as requested by competent authorities (if any);
• Representing Valued Customers to receive results.
