Termination of investment project’s operation

I.  Cases in which the investors terminate the operation of the investment project

1.  The investor decides to terminate the project;

2.  The project has to be terminated according to the conditions as prescribed in the contract or company’s charter;

3.  The project duration is over.

II.  Records for the procedure

In case: The investor decides to terminate the project

1.  Investor’s decision on project termination; 

2.  Investment Registration Certificate (if any).

In case: The project has to be terminated according to the conditions as prescribed in the contract or company’s charter

1.  Notice on termination of the investment project;

2.  Investment Registration Certificate (if any);

3.  Copies of documents recording the termination of operation of the investment project: the charter or contract in case of charter or contract recording the termination of operation of the investment project or decision of the investor, etc.

III.  Legal basis

1.  Law on Investment No. 61/2020/QH14 on 17 June 2020;

2.  Decree No. 31/2021/ND-CP on 26 March 2021 detailing and guiding the implementation of a number of articles of the Investment Law;

3.  Circular No. 03/2021/ND-CP on 09 April 2021 prescribing templates for documents and reports related to investment activities in Vietnam, outward investment activities and investment promotion activities.
